If it's speech then prohibiting me from broadcasting on the frequency
of my choice is a violation of the First Amendment. The very existence
of the broadcast industry depends on a monopoly imposed by the
government, so I'm not too impressed by 1st Amendment arguments by the
station. Now, 1st Amendment arguments from people asking for access to
the stations is another matter.
