Not really a different constant. It reports a calculation based on Base 2.
You can google it.
Regardless, you got the 40 gb drive.

If you did not have the restore and diagnostic partitions on your HDD,
Windows will report a single partitioned 40GB HDD, as having approximately
39.06GB free space. Windows uses a different constant for the GB value.

i've seen the restore partition take up to 5 gb.
go to mycomputer, manage, disk management and that will tell you what
size hard drive you have and how its partitioned.
