I will then mass fax to department heads of our government.
I share OG's question; if this is truly a civil rights issue, then
where is the ACLU in all this?
Not that I buy the premise that to be an authentic "civil liberties"
issue one has to have been blessed by the ACLU, but for those for whom
this "seal of approval" is important, well, we've got it. OK?
Here you go:
ACLU Backs Reynolds' Motion to Quash Grand Jury Subpoena for
Obstruction of Justice in U.S.A. v Dr. Schneider - Alex DeLuca;
Addiction, Pain and Public Health website; 2009-05-09.
The post contains links to recent articles which provide a lot of
background, from Sullum at Reason, Balko at the Agitator, Drug War
Chronicle, and History News Network.
There are also links to the ACLU "Amended Motion to Quash" and also to
Siobhan's earlier, pro se, "Motion to Quash."
Finally there is also a link to AUSA Tanya Treadways Subpoena so you
can read for yourselves how outrageously overbroad it is, and with all
the earmarks of prosecutorial misconduct of the sort we've become used
to in cases like USA v Shaygan, earlier this year.
So go to the post on the War on Doctors/Pain Crisis blog - chock full
'o good info and links. For here and now, just a snippet from the ACLU
“These subpoenas constitute an abuse of the grand jury process…
Because [Treadway's obstruction of justice] investigation lacks any
good faith basis, Ms. Reynolds does not claim a Fifth Amendment
privilege with respect to any of the materials sought by the subpoena.
(1) Ms. Reynolds maintains that she has committed no crime and that
there is nothing in the requested materials that could inculpate her
in the obstruction of justice, witness tampering or jury tampering.
For all of these reasons, this Court should quash the March 10
subpoenas issued to Siobhan Reynolds and PRN.” (pages 2 and 4)
