As far as I know, it is done, denied, and over. I had the option of going
one more step as a state (circuit?) court case, but the private disability
insurer said their burden of proof is different. (I think that means they
give more weight to doctors who have seen me and all my films, instead of
doctors who use has the Magic 8 Ball on their desks to decide.) Even two
different IME's who looked me over a total of 3 times were favorable towards
my getting SSDI.
It was basically done as courtesy for my private disability insurance. SSDI
would have only helped them with a little more than half, and not being able
to really do much else, I had even hope that one of the IME's would have
seen something to help. But my version of Judge Judy kept referring back to
the oxycontin issue, stressing dose adjustments and amounts and when I had
told the pain docs the dose wasn't adequate. The surgery got a bit more than
casual mention, and for some reason it seemed important to her to mention a
trip to Barbados the wife and I went on. I had a great deal of fun watching
TV in the bedroom and watching everyone else play on the beach.(I admit I
did get some time in the pool which was excellent for getting rid of gravity
on the spine)
No mention was made of the trips to Vegas,the Alaskan Cruise, trips to L.A.,
Mexico, South America, Egypt, and a couple other globe hops that I sent my
wife on alone (but with her folks, who would have gladly paid my way,
especially since most things are double occupancy anyhow) after the
wonderful experience of spending all day on a plane returning from that
Barbados trip.
And they say there's no justice in the world.
