Paper: Brown letter 'affront to the First Amendment'

I couldn't quite believe that, as that Florida Times-Union
editorial I linked to earlier suggests, Rep. Corrine Brown
had threatened a libel suit against a newspaper columnist for
the sort of criticism most politicians face.

But the columnist, Ron Littlepage, sends over the letter from
Brown's lawyer, and the characterization is accurate.

Brown's lawyer, Edward Booth, charges in the November 9 letter
that Littlepage wrote "intentional defamatory falsehoods
that are malicious in nature."

The evidence?

"The editorial states that Congresswoman Brown has done nothing
for her minority constituents during her
17 years in Congress, that she has delivered nothing for her
minority constituents and is only feathering
her own nest while in Washington," the lawyer wrote. *He also,
at one point, threatens to sue for "liable.")

That's it. (The column in fact doesn't even say Brown's never
done anything. It just laments African-American
poverty and asks what she's done.)

A lawyer for the Jacksonville paper, George Gabel, responded
that Brown's letter is an "affront to the
First Amendment":

"The Florida Times-Union will not publish any correction,
apology, or retraction as your client demands," he
wrote. "Lawsuits by public officials, like Congresswoman Brown,
challenging critisicm leveld against her
on the purported basis of defamation chills free speech and
freedom of the press. Such lawuits have never
been accepted by the courts -- and have actually been soundly
and repeatedly rejected."
