tribunal and executed.



LOL. How predictable. Why bother with a tribunal? In the old days
the field commanders could do it without waiting around for JAG REMF's
to come around. Here's a clue for you. The Rosenbergs weren't tried
by a military tribunal. Neither were Aldrich Ames, John Walker, Ronald
Pelton or any non-military personnel who were tried for treason. When
SCOTUS declined to review the case in 2004 it was due to procedural
reasons (circuit filing, improper designation of the respondent).
We'll see how even the new more right leaning court decides on this
when they hear it some time in 2007. If you had bothered to look at
the Hamdi opinions of various justices you'll realize it's far from a
slamdunk (to ridicule Tenet) on Rumsfeld getting his way on this even
with the addition of Roberts and Alito (though Thomas is fairly
predictable).
