Indoor Smoking:
On November 21, 2006, Summit County Council passed an ordinance banning
indoor smoking in most establishments that are not private residences.
Certain businesses are exempt under the ordinance such as hotels,
tobacco shops, bowling alleys, private clubs and racetracks. Not
exempt are bars, restaurants and bingo halls.
Akron passed its own Clean Indoor Air ordinance in 1990, banning
smoking in all publicly-owned buildings and restricting smoking in
businesses employing more than 25 persons.
The Law Department of the City of Akron has researched the new
countywide ordinance as it may apply to citizens of Akron. A Clean
Indoor Air ordinance was crafted in 1990, banning smoking in all
publicly-owned buildings and restricting smoking in businesses
employing more than 25 persons. The Law Department's opinion, based
upon the Constitution of the State of Ohio and the Charter of the
County of Summit is that when the City's Clean Indoor Air ordinance is
in conflict with the new County ordinance, the municipality's (Akron)
law shall prevail.
