I wish the med-mal lawyers woudl agree with you. They always have a
loophole, "The patient didn't understand the consequences of not
following the medical advice." Depends on the jury if they feel for
you or not.
Under libertarianism, the Med-Mal lawyers would be knocked down

Just put through a loser pays system like every other system in the
world (except us) and the frivilous suits would totally disappear.

Right. And it's exactly what the Libertarians would like to do.
If they ever want to gain any sort of traction with such a
radical proposal, they will have to come up with a workable
solution to prevent individuals from being bludgeoned by the
legal might of big corporations. It is plain unacceptable
to tell the people not to bother suing whatever their
reasons and however good their case unless they have a few
million in the bank.
Note also that in most other places in the world,expenses
liability is capped by law.
