Minor nit: no study has ever demonstrated an increased risk of FATALITY
associated with 2nd hand smoke. Several have demonstrated (and I think
they'd be hard to refute) that, in SOME people, there is an increase in
respatory irritations (asthma, etc.)

Still, I think that it should be up to the business owner. It is
unfortunate that the bans got a foothold, because the rhetoric "it's not
about the customer, it's about the EMPLOYEE" -- which DIDN'T USED TO BE
VALID -- now holds weight; "we're changing your work environment, if you
don't like it, quit" doesn't go well in America. I much preferred the
"was it a smoke-filled joint when you applied for the job?" approach.
