That's called a "Thought Crime" in George Orwell's 1984. It's called a "Minority Report" in the more recent Speilberg flick.
Either way it goes against everything the American Constitution stands for.
It's called intent. People get arrested for intent all the time.
Intent to distribute, intent to cause bodily harm, etc.
If you are arrested for planning an attack intended to cause large scale damage or dozens of deaths, you aren't being arrested for a "thought crime".
