.....the defendants herein, with the intent that a felony be committed, did
enter into an agreement with one or more of each other or with a general
purpose political committee known as Texans for a Republican Majority PAC
that one or more of them would engage in conduct that would constitute the
offense of knowingly making a political contribution in violation of
Subchapter D of Chapter 253 of Texas Election Code, a violation of Sections
253.003 and 253.o94 and 253.104 of the Election Code, in that said
contribution was made directly to the Republican National committee, a
political party, ......................
I'm not a lawyer, but my non-legal opinion is that Tom DeLay was listed on
the face of the bill of indictment along with others. The indictment
alleges that the "defendants" (of which one is Tom Delay" did enter into an
agreement.
It appears that they conspired (meaning three or more of them agreed that
this deed be done) to collect money for a Republican PAC turn that money
over to the RNC and then get the money back in ways that would not have been
legal for them to collect directly.
Individuals can give money in Texas...but not corporations. So it is
alleged they collected these monies from corporations, turned them over to
the RNC and then had them given back to Texas state candidates. These
candidates were elected and thus were able to redistrict Texas in ways that
cut up the constituencies of numerous Texas representatives to the United
States (not state) Congress in such a way as to eventually enable
Republicans to represent those Democratic divided districts though they
continued to vote for their old representatives.
Unfortunately, the gerrymandering is legal, but the big money from out of
state corp. laundered through the RNC used to get those extra state reps
elected may not have been legal.
So it appears that it now must be proven that Tom Delay knew and approved of
this plan to circumvent the laws of the Texas in a designed scheme to
collect the money, filter it through RNC, then return that Corp.
money....now RNC money...to the state candidates to defeat Democratic
candidates that were limited by law to money from individuals. Only the
means was illegal. The ultimate motive was a legal one. The motive was to
get the votes to redistrict so that ultimately the number of Republican reps
from Texas would insure the House of Representatives in Washington would be
strongly controlled by Republicans.
Again, Texas doesn't want huge out of state Corporations overwhelming the
state election process with out of state special interest money. DeLay
found away to circumvent the intent of the law. The burden of proving that
Tom Delay is guilty of a crime here would require proof that he knowingly
participated in this conspiracy and that he knew the money would be
collected and washed through the RNC then returned as donations to the state
candidates.
There are burdens of proof here as well as questions of law.
Hardly anyone who has seen those redistricted maps can argue that DeLay's
actions were moral. The only question is was it illegal.........and was he
aware of all these actions.
This is, of course, only my opinion. It is worth $0.....but one vote at the
polls.
