No, sorry, that's not the case.

It's both a civil and a criminal violation.
And nothing hinges on whether or not money is
made from the songs.

If I steal your song, you can sue me in civil
AND file charges in federal. Even if you've never
made a dime from the songs, and I've never made
a dime from the songs I've stolen from you, you
can prevail for potential damages, court costs and
punitive damages.

And if we live in separate countries, that are party
to the Bourne convention treaty, the state dept can
become involved and do whatever they do when there's
a treaty violation. I think they send a letter to
the other partie's government, "strongly condemning"
the violation.
