I won an auction, payment by paypal, and the seller shipped the item
with delivery confirmation. Problem is that he shipped an item that
is inferior to what was listed. I brought it to his attention. He
said he would make good, but, as you can guess, he didn't. Now we
have a problem. If nothing is resolved by friday, I plan on opening a
paypal dispute over this inferior item.

All my emails to the seller are through the ebay email system. The
seller's emails to me are all outside of ebay. His emails to me are
not replies, but, new emails. When I open the dispute, paypal will
see only my emails, nothing from the seller. They will see that an
item was delivered, but they have no idea what was in the box. I can
say that the item inferior, and the seller can claim I am full of ***
and making false claims. Since paypal cannot see the seller's emails,
they have to go on what is in front of them - my emails claiming
fraud, and no response from the seller. Since an item was delivered,
case closed. Now what do I do?


I have a suggestion that may eliminate this sort of seller fraud. Ebay
furnishes each seller and each buyer with a ebay email address. The
ebay TOS be written so that all correspondence between seller and
buyer be through this email address.
