Well that is not necessarily true, there are costs involved. in a case
where the connectionn is not being used by the owner at the time the cost
is minimal I'll agree. But doesn't the cable modem or DSL modem use a bit
more power when working vs idle? How about the router section of the AP?

Sorry, you need to understand both the law, what constitutes permission,
and the fact that intent does factor into the equation. These issues are
all still being worked out.

In time the law will I suspect arrive at a basis of if you don't have
permission you are wrong rather then the owner not locking things down. To
use the house anology again in my state (SC) if I find you in my house, I
can shot you. The state of my door lock does not come into question. While
gun violence will likely not be allowed if you latch onto my unsecured
router, I'm betting in time the law will reflact the notion you are the one
in the wrong, not me for being stupid.
Agreed there are intentionally open APs out there, in those case permssion
should be sought. I again think the burden will eventually (in law) be
placed on the person with the computer, not the AP.
