Lumpy voiced his/her/it's humble opinion in alt.guitar.beginner on Tue 10

Jim:
Here's an odd question... How 'bout downloading ONLY songs that
you already own from "questionable" sources? I say it's okay,
but if you do enough, you might get tagged and could have to
PROVE that you own a license for the songs. I will admit that I
have downloaded copies of some of the music I already own because
I'm too lazy to burn them myself! This is NOT legal advice (for
those of you who happen to know my profession).
Lump:
That's an interesting situation.
The host of the downloads is surely in violation.
I don't know of any references in the stat language
or case law that permit downloading from illegal
sources, for any reason.
Jim:
This is a legit question, because I honestly don't know. Say I do a
search of mp3's and download a few that I already own. Is my act of
downloading really illegal, or is the assumption that I don't have a
license the real problem?
I believe you that it's a legit question.
But unless the download site is licensed,
they are operating illegally. I can't imagine
that it's legal for you to download from a site
that is not allowed to have them to begin with,
regardless of whether or not you have the original.
How about this angle...You own the vinyl. You surely
don't have the right to have the CD, 8-track, cassette
etc free. Even if the physical media were free, it's
a separate license.
If I own the vinyl and I own the CD, I'm allowed to
give away or sell the CD and keep the vinyl. It's
two separate licenses.
I would suggest you would be better at searching for
some kind of definitive answer than I would.
I'm just a musician..;-)

Some pretty good stuff there Lumpy.
I used to buy the LPs and record them to cassette right away, store the
LPs in new plastic liners and play the cassettes. TDK 90s recorded to a
HK Pro level cassette recorder. This was mainly between 1976-85. The
Carole Pope, Rough Trade Live, digitally recorded LD totally blew me away
on my Harmon Kardom system in 1980. This early digital rendition of an
analog recording seemed light years ahead of everything else.
Not that I'd ditch my Stone's/yaddayadda. :o)
I still have my original recording from 45, "They're comming to take me
away haha!" Reverse too.
I guess, like a lot of folks tho, I collect stuff. Music, software
videos and almost anything I can burn to disk on my 'puter. I've never
tried to make a buck from it and 99% of it sits on a disk somewhere in
the caverns of my office never to be seen again.
I've only had dial-up for twenty years of computing on-line so how hard
could my impact be?
Like the makers of Leisure Suit Larry 1 (VGA) are going to haul my sorry
ass off to court.
Jeez, I should play that game again it was a lot of fun. Seriously.
Have you ever heard of a band called Coma Toast? Old GF of mine hooked
up with Darren Kerr. (Died @ 32, melinoma) ... wait a sec, gotta grab
the CD ... ah there it is, My Grain by Turtle Records. They had a second
album and I believe I have a copy somewhere in a box. Don't hold your
breath, I've got tons of boxes.
My fave was "Frothing" Maybe I could UL a slice to a binaries group for
you to peruse. A slice is ok? Right?
You want a 99.99% slice or just the usual 99.98?
Just yankin' your chain. I'm sure I can send up a significant piece of
his talent without crossing any legal boundaries.
Everyone else can D/L the whole CD @ alt.binaries.ripoff.rat.bastards
Anyway, hows about alt(dot)binaries(dot)***-music? Might be a day or
too but I'll label it Hey!Lumpy.
Just finished a 16 hour day running a gravel truck and the roads suck big
time. Lots of rain up here in the "Great White North" snd driving in
soupy gravel beats the crap out of us old farts.
Speaking of "Soupy". Have you seen White Fang lately? :o)
Later......
