I suppose this is a valid point. How do you know people
really work stuff out by ear and don't just copy from
official songbooks? Of course one publisher could copy
from another one, but at least the
artist would get his share.
I didn't mean to relate the books to online tabs, only
making an analogy.
Look at the example of performance and mechnical licenses.
Bob Dylan writes and performs a song. I hear it,
figure it out by ear, and then go out and perform it.
The venue is still responsible for paying for the
performance rights.
Then say I record an album with the same song. Still
figured out "by ear", I've never bought the record
or any *** music. I still have to pay the mechanical
license to Bob for the right to record and distribute it.
Then say I tab it out or transcribe it into standard notation.
If I distribute it at all, free OR for a fee, doesn't matter.
I still have to pay Bob for the right to distribute it.
The rights we're dealing with are INTELLECTUAL rights. It
doesn't matter if I buy the book and physically copy it
(although that is still another, separate copyright issue).
What does matter is that I'm reproducing the intellectual
material that Bob created.
