here another plunker rap on the permit..
Howdy,
Jeff Kline is NOT GARRICK'S ALLY.... he is doing a great deal
of damage by giving the Forest Service some "legal" (very shaky)
grounds to harass the Gathering... i.e. See 2004 "Ghost Signer"
routine for California... and the near riot when the LEOs jumped Gary
and crew... and then later gary lost in court because the Judge
accepted the Forest Service rap that the PERMIT SIGNING WAS LEGAL...
by someone who had never attended a Gathering before (or barely) and
who did so at the behest of Jeff Kline i.e. Alison Rodden....
The Rap laid out to me: JEFF KLINE IS DOING IT FOR THE FAMILY I.e.
for the brothers and sisters to come out unharassed... total crock
of jive...
if Jeff Kline and other folks who want to do something good for the
"family' they outa give the PEACE CHANCE garrick, myself and so many
other folks have been seeking for all these years of Gathering... a
SIMPLE ACCOMMODATION within the Law ...
DOING IT FOR THE FAMILY :
An example of this, is one that happened in 1995, New
Mexico... when, on July 11, in the middle of the night.. shots were
fired... then when everyone was looking near where the shots were
fired... and folks watching the garbage (neatly stacked, seperated,
ready to be hauled the next day)
rolled out to check on the shots...
Suddenly, a fire broke out, and the Garbage collected is all on
fire... it took a lot to put it out... and then the INVESTIGATION
began... after days of checking into this lead or that... I came to
the conclusion that this one person who seemed the likeliest "fire-
starter" was this feller I will call "Corny"...
but, after many days, I finally had a couple of folks who witnessed
this guy WAS NOT the person who started the fire...
It had been determined this guy had fired off the shots:
"I wanted to check out my gun, so i fired it a few times"...
was his rap...
Anyways, I had told this guy he was one of the folks being
looked at, and so, when I thought i had information that cleared
him... i walked by him... so I said to him...
"Corny, i thought you had done the fire, but after all the
checking.. folks witnessed you could not have done it... (reliable
people)..."
His reply, "Oh, i did it!"
I was blown away, but i asked, "Why?"
Crony says: "Oh, I knew that the family could never haul all
the garbage out... so i started the Fire and burned it so it would
help.. I DID IT FOR THE FAMILY." he walks away.
What Corny (and others who would help the family) did not seem to
understand was that I, others, had just spent days and days organizing
the garbage, seperating it... etc.. readying it to be hauled...
After the fire.. it took many days to package the wet, nasty,
mixed up garbage .... had fewer garbage bags to work with... and what
a mess... way worse to have to deal with... Corny, however, did not do
any of this work at all... and it was impossible, improbable he even
understood what a HASSLE HE HAD CREATED...
Just the other day, when this woman called (for jeff) this was her
rap: "Jeff is DOING IT FOR THE FAMILY".
No, Jeff is NOT an ally of garrick or the people... he is simply
someone bent on his own trip... and (even if his motive is good) he is
NOT helping -- except to show how the Forest Service USES, CORRUPTS
people to help their causes against the people.
YES, what is wanted and needed to for the Gathering, and
folks to accorded the same treatment as any other people on their way
to CHURCH or POLITICAL RALLY i.e. to be able to "ingress and egress"
-- enter and leave in Peace...
I far as I know, (all these years) NO OTHER people have been
oppressed by LEOs, as has the Rainbows.... as i have said many times,
"if this were an all Native American Ceremony a la Devil's Tower,
annually... or a African-American Rally (million person march) in no
way, shape or form would the Governments... local, state, national be
able to put their POlice Authority to suppress such an event...".
yep, ONLY Rainbow Gatherings.... Heads and Feds is the game....
The appropriate place for the LEOs is to act NORMAL, be WELL TRAINED,
and NOT violate civil rights of attendees... PERIOD..
If a Officer is needed i.e. for an actual potential crime... then, I
or many others will call a police officer, etc.. Otherwise, just
like any other Church, Cathedral, Political Rally... etc... the
POlice, Forest Service Law Enforcement, etc... should be WATCHFUL BUT
NOT INTERFERING...
the RESOURCE FOLKS WANT TO MANAGE THE GATHERING AS A
EVENT..
exactly as they should
the LAW ENFORCEMENT INCIDENT COMMAND WANTS TO MANAGE THE
GATHERING AS AN INCIDENT... better pay, benefits...
It has cost MILLIONS OF DOLLARS for heavy law enforcement..
both in time on the ground, and in Courts... what a waste...

In the June 9th, Letter... one sentence in the June 9 Letter:
".... should we require to do so." regarding a "permit signer".
This gives an opportunity for the Forest Service, and you
Jeff (if you will, since you seem to have some "authority" in these
matters) to NOT require a PERMIT SIGNER...
"....as we discussed in previous meetings, it will be necessary
for someone who plans to attend the Gathering to sign the non-
commercial group use permit for it to take effect under our
interpretation of the regulations. This permit is required by law, and
is intended to protect the health and safety of the attendees, and to
protect the environmental and archeological resources of the public
lands to be used for the Gathering under the permit. We are already in
contact with more than one individual planning to attend this year's
Gathering who would prefer for us to issue a permit without requiring
a signature from an attendee, but are willing to sign the permit in
his/her capacity as an individual contact person SHOULD WE SO
REQUIRE.. Accordingly, since we have already identified more than one
person willing to sign, we are planning for the 2009 National Rainbow
Family Gathering to be a legally permitted event." (emphasis added)
I have written of this before in a previous email, but I
wanted to seperate it out and emphasize this simple OPTION:
SIMILAR EXAMPLE:
In every Gathering, there has been many, many times when the
Forest Service FIRE PEOPLE come out to the Gathering and tour the
various FIRES.. and when they do so, then, IF THE FIRE IS COOL, the
Forest Service Resource Officer issues a "CERTIFIED FIRE" i.e. they
issue a FIRE PERMIT...
Even under the worst FIRE conditions, when things is way
tough... some Fires are allowed... very well done, well set-up
Fires.... for the safety for all concerned, this is a workable plan...
the INDIVIDUALS WHO'S FIRE, the internal FIRE WATCH of the Gathering,
and the Forest Service RESOURCE (in a sense) agree upon, and then the
FIRE is authorized.... it works well, in Gathering and out...
If a correction needs to take place... before mutual
"authorization", by the person who has the Fire and the Forest Service
and the Gathering Fire Watch (volunteers)... then change is
forthcoming, prior to CERTIFICATION.
it has worked well for many, many Gatherings...whether there
is the other "PERMIT" or not....
The same or similar process can be used, easily, by Forest
Service in regards to the PERMIT... I outline the PROCESS for this
(again):
Note: this is NOT a new concept... it is one that many, many
folks have worked on developing, over the years, with the Forest
Service... notably, in Colorado 2006... this approach was emphasized
in many, many get-togethers between Forest Service and gatherers...
Please consider this approach...
Jeff, please lobby, petition (or whatever magic you use to
cause the Forest Service to respond to you) and please see this is a
PEACE WAY, a PEACE PLAN:
(speak to garrick about this... he and i, among so many others,
have lobbied for this approach)
SIMPLE APPLICATION PLAN re: 36 CFR 251 REGULATION i.e.
concerning such events as "Rainbow Gatherings" :
A Simple Plan for all this PAPERWORK has always been available
to the Forest Service:
Under 36 CFR 251, 'alternative manner" clause, et. al.,
A District Ranger and/or authorized officer COULD/should use this
approach:
(1) NOTIFICATION, RESERVATION through the ORAL OR WRITTEN
communication i.e. application -- an individual/s contacts the FS and
lets them know a Gathering is coming and checks to See if the space
has been reserved... or is not... because enivonmentally suited,
etc...?
(2) Once a MUTUAL SITE is "reserved", a SPECIAL USE on a
specific Site on Land the People seek and find AMONG SITES appropriate
i.e. concerning archeological, environ, et...
(3) Communicate with and work with the PEOPLE ON THE
LAND.. simple recognitions as written in the June 9 Letter (Jeff Kline
used some of the right words... at least)... DEVELOP OPERATING PLAN
-- WRITTEN OR ORAL ...
Remember, for many, many years so-=called "operating plans"
were developed on-Site between folks and Forest Service Resource
people (plus health folks) whether the Gathering was considered to be
LEGAL OR NOT... many of these 'operating plans" were ORAL raps...
(4) Operating Plan is developed mutually :
(a) first draft is worked out: with the people, among the
people, on-Site and communicated to the people on-Site..
(b) then worked out with Forest service, mainly resource --
law enforcement (way) back-up... again, developed on-Site with the
PEOPLE ON THE LAND...
(c) once mutual DRAFT.. then the DRAFT IS FLOATED THROUGH
CIRCLES... in the Gathering... as the Gatherings does...
(5) FOREST SERVICE SIGNS THE PERMIT THEMSELVES:
(a.) Once Forest Service is in CONSENSUS with DRAFT.... and/
or they WITNESS the Gatherers responding accordingly... i.e. the
OPERATING PLAN IS BEING CARRIED THROUGH IN THE GATHERING...
(b.) Then, the Forest Service Resource i.e. District Ranger,
et. al., can CERTIFY THEIR APPROVAL by SIGNING THE PERMIT (if they so
choose)... and GIVE IT TO THE GATHERING.. i.e. DONATE IT TO THE MAGIC
HAT...
(c) THE FOREST SERVICE COULD SIGN THE PERMIT i.e. CERTIFY
THE GATHERING has met their "standards" i.e. with an OPERATING PLAN..
(d) Forest Service can use this as a Way to INFORM THE
PUBLIC THE GATHERERS Special Use of THE PUBLIC LAND is under
STEWARDSHIP of the Forest Service, and the Gatherers (whoever they
are, and whatever type of gathering) has a good "operating plan"
taking care of the concerns i.e. environmental, health, etc...
HOW DO I KNOW THIS CAN WORK?
tthree examples:
(1) Idaho, 1982 Gathering.... this PROCESS HAPPENED
EXACTLY... -- unbeknownest to the Gathering, the Regional Forester
Gene Benedict mailed a 'signed permit" SIGNED BY THE FOREST SERVICE,
in c/o me (plunker)...
(2) In 1987, regional in Montana... WITHOUT ME EVEN
APPLYING.... Forest Service issued Barry Adams, a permit signed by the
forest service....
i put this paperwork into Federal Court INTO MY MONTANA DEFENSE...
(3) In New Mexico, (end of) July, 2007...
Dan Rael testified in Federal Court that when Sp (and D.M.)
entered an Application "Full Moon" (?).. that sp did so in the
appropriate fashion, i.e. as an individual and lobbying for the
"alternative manner" i.e. Mark Rey and Forest Service
"accommodation"....
Now, apparently there was some discussion of (later on)
someone signing a "permit" however, Dan Rael, according to his
testimony did AUTHORIZE the event.... based on sp's application....
(too late for ugly scenes officers beating, harassing gatherers).
So, in effect Dan Rael was "on this track" I am
speaking of...
It is an acceptable track to me, and I have been in this Legal and
Gathering struggle for over 40 years.
IF THE FOREST SERVICE NEEDS A SIGNED PERMIT LET THEM SIGN IT
AND DONATE IT
TO THE MAGIC HAT (where all donations flow)...
please consider this... it is a (likely) workable PEACE PLAN.
