It could be(and has been) considered a cluster of both. That's why
defining is so convoluted. Too often folks want it both ways at
once. Or changeable at will (theirs).

Yep. Feds take advantage of that. I argue in my discrimination
complaint against FS that the fact the the Gathering is advertised
(internet, etc.) as a public event overrides any gathering traditions
that would otherwise only be allowed at a public event. Feds say it's
a private event which is why it is ok to have gatherings traditional
rules like no photographs - it would otherwise be a civil rights
violation. Feds say that Civil Rights protections under the Civil
Rights Act of 1964 and Section 504 of the Rehab Act etc. are not
applicable at these private group events. All gatherers lose these
Civl Rights protections when attending an event operating under non-
commercial group regulations - signed permit or not.

Based on many discussions I've had and been witness to with LEOs
at gatherings, they always maintain it's a public event and anyone
can film at a public event.
