The distinction is the ex-officio permission / authorization /

you are with (as in the general vicinity) you are "one of those" and
guilty by proximity.  Yeah, it's a fraud, but if you protest you'll be
told "ignorance of the law is no excuse" and if you claim a different
name for your group the Gummint'll just tack on another bugus charge
you'll have to fight.  All because High Holy Idiots think they can
barter Liberty for safety and don't care about involving others in
their doom.

No one in history has ever gotten the safety they surrendered their
Liberty for.
