No.

(and if not, how would they prevent people from signing up, getting the
free download, then cancelling?)

D3 is played on Bnet, and your access is disabled on your PC if you
cancel your description.

Also, in order to cancel once you've signed up, you cannot cancel via
the account page, you actually have to call customer service and get
them to do it, and if you do so, you are permanently excluded from any
future Blizzard offers, betas, and so on.
