Yeah. "If". The burden of proof requirement on that one is pretty
steep. After all, these things are written by lawyers whose job it is
to ensure that their client is protected. The relative dearth of
anti-EULA lawsuits, much less successful ones, indicates just how
difficult it is to meet that burden.
I think you'll have difficulty finding any part of the EULA that
conflicts with the law, doubly so the constitution.
