Ok, here's the deal: A level 40 player could never kill a level 50 mob, because he won't hit him often enough while getting constantly critted from the mob. This is why blizzard "invented" elite mobs. You have the same chance of critting an elite 40 as a normal 40 and vice versa. But the elite one has more health/mana, hits harder and has special abilities. Basically every "swing" against an elite is computed like if it was a non-elite, but it takes longer to take him down due to higher armor/health/etc. A level 39 elite is easier to solo for a level 40 player than a level 45 non-elite.

When you fight against a player, the level is (basically!) irrelevant.
The "only" differences between a level 30 and a level 60 fighting
each other are:
- The level 30 has his weapon skill and his defense on 150 - The level 60 has his weapon skill and his defense on 300
- The level 60 has more mana/health/armor/stats than the level 30


Trying to crit something that has 300 defense with only 150 weapon
skill is close to impossible. To get critted by something with 300
weapon skill, while you have only 150 defense.

BUT: There is no calculation when fighting P v P that takes the
level difference into consideration, only the aforementioned
consequences of a higher level (skills, armor, stats).

Conclusion: To kill a mob +5 levels above you is close to impossible.
To kill a player +5 levels above you is not perfectly fair, but no
big deal.
