The code needed to access it is part of the original product, it's inside the DVD case.

Doesn't matter what they say. It's included as part of the original product.
This is EA basically trying to squeeze money out of people, whether it's fair or not is a matter of opinion. Take Shayle from DA and the Marc chap fro ME2, both were blatantly developed as part of the original game but deliberately marketed as "extra" content.
Like I said, what's this si a fair practice or not is matter of opinion. I don't buy used games anyway so it's not an issue for me but it strikes me as underhanded.
The code instructions are very specific though and (at least) on the PC version, it states that once the code is used, it no longer is a valid code. So I think EA made it clear for what and how many times this code is to be used. That would be like getting a game with a 48hr trial code for use XBL and being able to use it over and over again just because it was the original code with the retail package.
