It's an interesting debate. A question to consider is whether you're
buying rights to the game or rights for you to play the game? You're
not really purchasing a product like you're purchasing a car or a
television. You're purchasing the ability to view intellectual
material.

It's an iffy scenario. I would love to see how courts rule on it.

Same here. I be even more interested to see how they'd rule on some of the insane stuff that publishes are subjecting PC gamers to. Forcing CD keys to be linked to steam accounts, limited number of installs, and apparently Assassins Creed 2 will need a constantly open net connection.

Ultimately, when you transfer a game to someone else, you're engaging
in one of the practices that pirates engage in, which is giving the
ability to play the game without paying the appropriate licensing fee
to the creator.

But the difference is that the produce is being transferred not copied. You have to remember that a good number of people will buy a single player game new, with the intent of finishing it then part exchanging or selling it These people would think twice about getting the game if it had less resale value. so .

I'm not sure ho big the "used" market is outside he UK but over here my local branch of game (Well known UK video games shop) has a hell of a lot of used games. If this is typical of the rest of the world then I'd have thought that is was probably a high contributor to the whole idea of "Project 10 Dollars" in the first place.
