Nope according to MS ,you can now rent NETFLIX downloads free with a
Gold Account here's the E3 reveal

The content owners already have the right to control a public showing of their
titles, so you could say that the content holders could sue to prevent this
from taking place since it could be considered a public showing.

The studios' lawyers would have to figure out how to prove that this
would be a public showing. The functionality does not allow any 7 or 8
random people to just stroll on into the forum and start watching. The
fact that there is such a small limit to the number of people who can
participate and the fact that they have to be invited into a private
session with the renter/owner makes it a private showing.
