Currently I have seen no reports of people being banned from Live for
connecting with a modded 360. With the original Xbox they would ban
the specific modded Xbox itself from Live, but would not terminate
your Live account.

Most people would keep 2 systems, one modded and the other unmodded to
use on Live.

Connecting to Live with a modded box is against their TOS though, so
they certainly have the right to terminate you service in the future
if they feel like it. I wouldn't do it. No doubt it would be easy
enough for them to detect.
