Vicegerent, no I don't believe the UCLA professor for a couple of
reasons, mostly that it's based on conjecture. He talks about
Infinity/CBS being damaged and the ratings having "cratered." Well
according to CBS, they had record profits and sold the shit out of the
show because it was Howard's last year on CBS and ratings and ad
revenue were better than ever on Infinity stations, especially in the
last month. Don't forget that none of the Infinity stations dropped
Stern early. It was only outside stations that bought him from
Infinity. And Stern claims that he went to Joel Hollander and said he
wouldn't talk about Sirius if they objected, which they obviously
didn't, and even if they did, being able to talk about anything you
want because of your contract stating that you can negates that claim
anyway. And if they were so upset, why did they go on one of his last
shows and wish him well?
Then he says that the employees might have been encouraged to break
their own contracts. That's assuming they had long-term contracts to
begin with. Of all the employees of the show, how many do you think
actually had long-term contracts? You might want to imagine that they
all did, but since Stuttering John left with only giving a 2 week
notice, I'm going to guess that Richard and Sal didn't have long-term
contracts either. And if they did, you can bet your ass that they
didn't let them sign deals that were longer than Howard's contract.
He's not an idiot, you know? And since Artie is a principal, I'm sure
he signed a contract, but for how long? You think they're going to
offer him a long-term contract when he's only been on the show 4 or 5
years? I doubt it. That leaves Fred and Robin. Do you really think
their contracts didn't expire when Howard's did? They have been
working together since the beginning, pretty much. And you're high if
you think their contracts didn't coincide with Howard's. And the guy
even admits it's a shaky argument. So who's left to argue over? Scott
the Engineer? Ronnie the Limo Driver? They're paid employees with no
obligation to Infinity whatsoever and can go where they want. And who
cares anyway? I don't think anything about employee stealing is
mentioned in the suit. Nobody but this guy has mentioned it. So
you'll have to forgive me for seeing this UCLA guy as someone who has
no knowledge of the situation and is giving an opinion based on reading
CBS' filing.
I think what's going to come out of this suit is an agreement about
Howard using the old tapes. They're going to meet behind the scenes
and say, "Look, give us X amount of money plus mechanicals for the
tapes and we'll drop the suit." Then they'll negotiate it out and this
suit will go away, people that were waiting to see how well his show is
going before committing will buy Sirius radios based on all the hoo-ha,
and everyone makes money on the deal except us.
Now let me translate all that for the pests:
"Howard not gonna lose money. CBS no prove case. Howard lots of
publicity. Nobody care O&A.."
This is all well and good, but unless you know something you aren't telling
us, everything you just posted is based on conjecture also.
