I think you found a contradiction.
DD was sure that Harry death was intended to make a horcux and guess that
wasthinking he failed, made the snake into one. We find out later that he
clearright and did make the snake into a Horcrux. So while the books seem
said athat Harry was to be the death LV was to make his last Horcrux... she
couple of times...
"Harry was not technically a Horcrux, due to Voldemort's lack of intent"
that there was no intent to make a horcrux when he [tried] to kill Harry.
Luckily, conjecture, even on DD's part, doesn't make it so. :)
A bigger issue is what happened to all the *other* soul pieces that
were ripped away from the whole by murder?
We know Voldemort murdered hundreds of people personally... if not
thousands... and only a very few of the ripped soul pieces were made
into Horcruxes.
Actually - that can be deduced from Harry's experience.
We KNOW that Harry was not properly prepared - and that the murder was not
performed with the intent.
We don't know that. We don't know if Voldemort was going to use
Harary's murder as his final Horcrux. All we know is he wasn't
thinking about it right before he died (if his memories of that night
can be trusted, and they do contradict his claims James fight back.)
We also know that the soul fragment latched
itself onto the nearest living thing it could find. That was because
Voldemorts mortal body had been destroyed.
Of course - that leaves a plot hole too.
Voldemort was able to murder - even when he had not yet returned to full
form.
We do not know if that would have split his soul - or where those fragments
would have gone.
And - of course - Nagini becomes the problem there. When did he make Naginin
his final Horcrux?
Between GOF and OOP. V had to have known quite early upon his return
Luscius cost him the Diary, so he'd want to make one new one ASAP.
