Took me a while to find it too but it's explained by the fact that
despite both the Dursleys *and* Harry having made the definite
decision that he was leaving Privet Drive... for good... and despite
all the Dursleys having already *left* Privet Drive... the charm held!
As we saw, the Death Eaters couldn't attack Harry until he not only
left the building but rose up out of the protection of the magic
'bubble'.
Moody did say once they leave it's Range.
Moving slightly off topic here... I'd really like to put that point to
JKR and ask what would have happened had they all immediately dropped
back to the protection of the house! :)
Another question to ask would be... since Mundungus had disapparated
what was stopping the others simply doing the same... immediately!!
They were after all under attack and even *if* the Ministry complained
they had good reason under the law?!?! We know it can be done... Harry
and Hermione jumped out of a window and did it!!
I would also like to ask her to explain the rationale of not sending
Harry and Moody by side-along apparition... when they *could* use
"Diss?lusion Charms" and ride broomsticks without censure?? I'm *sure*
both broomstick use and disillusion charms count as magic!! :)
