Doesn't make a lot of sense really. DD's spell held Harry and was only
released when DD died. If DD had been dead at the time, his spells
wouldn't have worked following the apparent logic J(K)R has put in her
books.
Think of it not as DD being dead, more like in remission of a terminal
disease. Snape has alraedy told us that he has the power to put a
stopper in death, he was merely delaying the inevitable.. This also
gives us the platform to see Snape being revealed as a true and loyal
member of The Order.
