I think that is why Myrtle is the "debated candidate". Everyone
agrees that Myrtle died when looking into the baskalist eyes. Some
think that the baskalist was the "weapon" used that killed Myrtle
and that Tom should get the "credit".
In the same way, if Toon would throw someone into a tank of sharks
with lasers attached to their heads, we would consider Toon the
killer, and not the sharks.
But what if Toon has the sharks planned for someone else and you trip
and fall down into the tank? Is he still a murderer? As I was
reminded, there were other incidents but no one else died. Myrtle
could have been in the wrong place when the basilisk appeared
Was Tom planning to kill her or any other muggle? Hard to tell, but
the scene of him trying to figure out what the consequences of his
action were, looks as he didn't expect it. I don't think Riddle had
wanted Hogwarts to close, nor he considered something to cause it.
In this case, Toon would be at least guilty of manslaughter... it's
irresponsible not to put a cover over your tank of sharks with lasers
attached to their heads.

In Tom's case, I think it was unclear if it was a mistake or not. I don't
think it was planned beforehand... but it is possible that Tom told the
basilisk to kill her. I agree that Tom didn't want Hogwarts to be closed.
He ordered a kill, but maybe he only knew a muggle born was in there,
not specifically who.
