Again,this is a big jump-to-conclusions.
That a particular set of portraits are all of dead people
does not mean that it is necessary,or even possible,for a
person to be dead at the time a portrait is created.

Would a Dementor who sucked out the soul of someone who
had left most of his soul in Horcruxes be left feeling
cheated/hungry?
