I believe it was in OOtP where it was stated that eye contact is
required for Legilimency (or a mental link like Harry/Voldemort shared
in book 5). Is there any reason at all to suspect that at some point
in time after suspecting Draco of wanting to kill him that Dumbledore
looked him in the eye? Keep in mind that most students never have
contact with the Headmaster, excepting when they listen to his oddball
speeches at formal events.
