by imprisonment in a county jail not exceeding one year, or by
both the fine and imprisonment.

As a general rule, misdemeanors (in California anyway) receive
sentences of "up to" one year and are sent to County Jail.
Felony convictions result in "more than" one year and result in
State Prison.

So "not exceeding one year in the county jail" tells me it's a
misdemeanor.

Yeah, it's not like those class 6 felonies.....

*snickers*
